What is this about and does it really apply to me?  Well, when you build an extension to your property, or your neighbour does, there are some legal requirements that need to be followed under the Party Wall etc. Act 1996. A ‘party wall’ doesn’t just mean the wall between two properties, it also covers:

  • A wall forming part of one building but which is on the boundary line between two or more properties.
  • A wall which is common to two or more properties, this includes where someone constructed a wall and a neighbour  subsequently built something butting up to it.
  • A garden wall, where the wall is astride the boundary line or butts up against it and is used to separate the properties, but is not part of any building.
  • Excavation near to a neighbour’s property.
  • Floors and ceilings of flats.

Boundary Issues


A boundary is an imaginary line that divides pieces of land and is thus marked by a physical feature.  It has two dimensions.

Boundary issues can arise when building works occur, for example, new extensions or even demolitions.   Alternatively, boundary queries can raise their heads when new neighbours move in next door and start moving hedges or fences to suit their requirements.  It might just be that you want to make sure you know where the boundaries to your property lie because you are thinking of selling it, or it is going to form part of your estate for your family to inherit one day.

Boundary disputes can be very stressful and are sometimes fought with a passion which seems out of proportion to the importance of what is involved in practical terms.  It is therefore best to avoid them or resolve them as swiftly as possible.
